Terms of Service

1.1 About GunBuy

gunbuy.com.au ("GunBuy", "we", "us", "our") is an online classifieds platform operated in Australia that facilitates the listing and discovery of used firearms between licensed individuals and licensed dealers. GunBuy is operated by Townsend Investment Group Pty Ltd ABN 42 649 952 983 registered in Qld, Australia.

1.2 Acceptance of Terms

By accessing, browsing or using the gunbuy.com.au website, mobile application or any associated services (collectively the "Platform"), you ("User", "you", "your") acknowledge that you have read, understood and agree to be bound by these Terms of Service ("Terms"), our Privacy Policy and any additional guidelines, policies or rules applicable to specific features of the Platform.

If you do not agree to these Terms in their entirety you must immediately cease using the Platform.

1.3 Capacity to Contract

By accepting these Terms you represent and warrant that:

• You are at least 18 years of age
• You have the legal capacity to enter into a binding contract under Australian law
• You hold all current, valid and applicable firearms licences required by your state or territory to possess, use, buy or sell any firearm you list or enquire about on the Platform
• You are not prohibited by any court order, parole condition, intervention order, licence suspension or any other legal instrument from possessing or acquiring firearms
• All information you provide to GunBuy is accurate, current and complete

1.4 Changes to Terms

GunBuy reserves the right to modify these Terms at any time without prior notice. Changes take effect immediately upon publication on the Platform. Your continued use of the Platform following any modification constitutes your acceptance of the revised Terms. It is your responsibility to review these Terms regularly.

2.1 Classifieds Platform Only

GunBuy operates exclusively as an online classifieds advertising platform. GunBuy is not a firearms dealer, broker, agent, auctioneer or facilitator of firearms transactions. GunBuy does not buy, sell, transfer, handle, store, ship or take possession of any firearm at any time.

2.2 No Party to Transactions

GunBuy is not a party to any transaction, agreement, negotiation or arrangement between buyers and sellers on the Platform. Any contract for the sale or transfer of a firearm is formed solely between the buyer and the seller. GunBuy has no involvement in, control over or responsibility for any such transaction.

2.3 Information Platform Only

The Platform provides a venue for users to publish and discover classified listings. GunBuy does not verify the accuracy, completeness, quality, safety, legality or appropriateness of any listing beyond the basic verification procedures described in these Terms. GunBuy does not endorse any listing, seller, buyer or firearm advertised on the Platform.

2.4 No Transfer Facilitation

GunBuy does not facilitate the physical transfer of any firearm. All transfers must be conducted through a licensed firearms dealer in accordance with the applicable laws of the relevant Australian state or territory. The listing or discovery of a firearm on the Platform does not constitute any part of the legal transfer process under any Australian firearms legislation.

3.1 User Responsibility for Legal Compliance

You are solely and entirely responsible for ensuring that your use of the Platform and any transaction you enter into complies with all applicable laws including without limitation:

• Firearms Act 1996 (NSW)
• Firearms Act 1996 (VIC)
• Weapons Act 1990 (QLD)
• Firearms Act 1973 (WA)
• Firearms Act 2015 (SA)
• Firearms Act 1996 (TAS)
• Firearms Act 1996 (ACT)
• Firearms Act 1997 (NT)
• Any regulations, codes of practice or guidelines made under those Acts
• Any other applicable Commonwealth, state or territory legislation
• Any applicable local laws or regulations

3.2 Licence Requirements

You must hold a current, valid firearms licence appropriate for the category of firearm you are listing, purchasing or enquiring about. It is your responsibility to understand the licence category requirements in your state or territory. GunBuy accepts no responsibility for any transaction entered into by a user who does not hold an appropriate licence.

3.3 Mandatory Transfer Through Licensed Dealer

All firearms transactions facilitated through listings on the Platform must be completed through a licensed firearms dealer in accordance with the applicable state or territory firearms legislation. Under no circumstances may a firearm be transferred directly between a private seller and a private buyer without dealer involvement where required by law. Users acknowledge this obligation and accept full responsibility for ensuring compliance.

3.4 Prohibited Firearms

You must not list any firearm that is prohibited under Commonwealth, state or territory law including without limitation:

• Automatic firearms
• Semi-automatic centrefire rifles (except where specifically licensed)
• Semi-automatic and pump action shotguns (except where specifically licensed)
• Handguns that do not comply with applicable licence conditions
• Any firearm subject to a prohibition order
• Any firearm that has been illegally modified
• Any stolen firearm
• Any firearm with an obliterated, removed or altered serial number
• Any firearm imported into Australia contrary to Commonwealth law

3.5 Stolen Firearms

You warrant that any firearm you list on the Platform is not stolen property. Listing a stolen firearm is a serious criminal offence. GunBuy will cooperate fully with law enforcement authorities in any investigation involving stolen firearms listed on the Platform and will provide all available user data and listing information upon receipt of a valid legal request.

3.6 Interstate Transactions

Firearms laws vary significantly between Australian states and territories. It is your sole responsibility to understand and comply with the laws of both the originating state and the destination state in any interstate transaction. GunBuy accepts no responsibility for any transaction that is unlawful in any jurisdiction.

3.7 GunBuy Not a Compliance Authority

Nothing in these Terms or on the Platform constitutes legal advice. Any information provided by GunBuy regarding firearms laws, licence requirements or transfer procedures is general information only and may not be current, accurate or applicable to your specific circumstances. You should obtain independent legal advice regarding your obligations under applicable firearms legislation.

4.1 Registration Obligation

You must register an account to list firearms, send enquiries or access certain Platform features. You agree to provide accurate, current and complete information during registration and to update your information promptly if it changes.

4.2 Licence Verification

GunBuy requires all users who wish to list firearms to submit a copy of their current firearms licence for verification. By submitting your licence you:

• Warrant that the licence is genuine, current and has not been suspended, cancelled or revoked
• Consent to GunBuy storing a copy of your licence document in accordance with our Privacy Policy
• Acknowledge that GunBuy's verification process is an administrative check only and does not constitute legal verification of your entitlement to possess or sell any particular firearm
• Accept that GunBuy may suspend or terminate your account if your licence expires or is found to be invalid

4.3 Verification Limitations

GunBuy's verification procedures are implemented in good faith to reduce misuse of the Platform but do not guarantee the authenticity of any licence document. GunBuy accepts no liability for any loss arising from a fraudulent, forged or invalid licence document submitted by any user.

4.4 Account Security

You are solely responsible for maintaining the confidentiality of your account credentials. You must notify GunBuy immediately if you become aware of any unauthorised use of your account. GunBuy accepts no liability for any loss or damage arising from your failure to maintain account security or from unauthorised access to your account.

4.5 One Account Per User

You may only maintain one active account on the Platform. Creating multiple accounts to circumvent a suspension, ban or verification requirement is strictly prohibited and will result in permanent termination of all associated accounts.

4.6 Account Termination

GunBuy reserves the right to suspend or terminate any account at any time without notice at our sole discretion including where we reasonably believe a user has breached these Terms, provided false information, engaged in fraudulent activity or poses a risk to the safety or integrity of the Platform.

5.1 Accurate Listings

All listings must be accurate, complete and not misleading. You must not misrepresent the condition, specifications, provenance, legality or any other material characteristic of a firearm. You are solely liable for any loss suffered by a buyer as a result of an inaccurate or misleading listing.

5.2 Prohibited Listings

You must not list any of the following on the Platform:

• Any firearm prohibited under applicable law
• Any stolen firearm or property
• Any firearm with an altered or removed serial number
• Unregistered firearms where registration is required
• Firearms components or parts that are themselves prohibited or regulated without the required licence
• Ammunition (unless GunBuy expressly enables this category in future)
• Silencers or suppressors without appropriate documentation
• Any item falsely described as a firearm or firearm component
• Any item designed to convert a legal firearm to an illegal configuration
• Any firearm being sold on behalf of an unlicensed third party without appropriate authorisation
• Any firearm subject to a legal dispute, court order or restraining notice

5.3 Listing Content Standards

All listing content including photos, descriptions and communications must:

• Be in English or include an accurate English translation
• Not contain offensive, discriminatory, threatening or illegal content
• Not contain personal information of third parties without their consent
• Not contain misleading pricing including artificially inflated prices designed to manipulate search results
• Not contain contact details in the listing description designed to bypass the Platform's messaging system
• Not link to external websites for the purpose of completing a transaction outside the Platform

5.4 One Firearm Per Listing

Each listing must relate to a single specific firearm. Bundle listings of multiple firearms are not permitted unless GunBuy expressly permits this in writing.

5.5 Listing Removal

GunBuy reserves the right to remove any listing at any time without notice and without refund of any listing fees paid where we determine in our sole discretion that the listing violates these Terms, applicable law or the spirit of the Platform. GunBuy is under no obligation to provide reasons for listing removal.

6.1 General Prohibited Conduct

You must not engage in any of the following conduct on or in connection with the Platform:

• Violating any applicable law or regulation
• Impersonating any person or entity or misrepresenting your affiliation with any person or entity
• Providing false, inaccurate or misleading information at any time
• Engaging in fraudulent activity of any kind
• Harassing, threatening, intimidating or abusing any other user
• Attempting to circumvent any security feature, verification system or access control on the Platform
• Scraping, harvesting or data mining the Platform without GunBuy's express written consent
• Using automated tools, bots or scripts to access or interact with the Platform
• Attempting to reverse engineer any part of the Platform
• Introducing malicious code, viruses or other harmful material to the Platform
• Using the Platform to conduct transactions for any item other than legally owned and appropriately licensed firearms and accessories
• Attempting to complete a firearms transaction without involving a licensed dealer where required by law
• Using the Platform messaging system to send unsolicited commercial communications
• Posting the same or substantially similar listing multiple times to manipulate search results
• Misusing the reporting function to target legitimate users

6.2 Prohibited Transaction Conduct

In connection with any transaction facilitated through the Platform you must not:

• Agree to transfer a firearm without involving a licensed dealer where required by law
• Accept payment through any mechanism designed to avoid detection or accountability
• Refuse to allow a buyer to arrange transfer through their preferred licensed dealer
• Represent yourself as a licensed dealer if you are not
• Facilitate a transaction with a buyer you have reasonable grounds to believe is not licensed to acquire the relevant firearm
• Engage in price manipulation or shill bidding of any kind
• Agree to split a transaction to avoid regulatory thresholds

7.1 Platform Provided As Is

To the maximum extent permitted by Australian law, GunBuy provides the Platform on an "as is" and "as available" basis without any representation or warranty of any kind whether express, implied or statutory.

7.2 No Warranty as to Listings

GunBuy makes no representation or warranty regarding:

• The accuracy, completeness or reliability of any listing
• The condition, quality, safety or legality of any firearm listed on the Platform
• The identity, licence status, creditworthiness or trustworthiness of any user
• The outcome of any transaction entered into between users
• The availability of any listed firearm at the time of enquiry
• The suitability of any firearm for any particular purpose

7.3 No Warranty as to Platform Availability

GunBuy does not warrant that the Platform will be available continuously, without interruption or error free. GunBuy may suspend, modify or discontinue the Platform or any feature at any time without notice.

7.4 Consumer Guarantees

Nothing in these Terms excludes, restricts or modifies any right or remedy or any guarantee, warranty, term or condition implied or imposed by the Australian Consumer Law (Schedule 2 of the Competition and Consumer Act 2010 (Cth)) that cannot lawfully be excluded, restricted or modified. To the extent that GunBuy provides a service to consumers as defined under the Australian Consumer Law, any implied guarantee that cannot be excluded is limited to the re-supply of the service or payment of the cost of re-supply at GunBuy's election.

8.1 Exclusion of Consequential Loss

To the maximum extent permitted by law, GunBuy excludes all liability to you or any third party for:

• Any indirect, incidental, special, consequential or punitive loss or damage
• Loss of profits, revenue, business, contracts, anticipated savings, data or goodwill
• Any loss arising from a transaction between users of the Platform
• Any loss arising from your reliance on information published on the Platform
• Any loss arising from the conduct of any other user
• Any loss arising from a firearm that is defective, unsafe, stolen or illegally modified
• Any loss arising from a transaction that does not comply with applicable firearms legislation
• Any loss arising from Platform downtime, data loss or security breach
• Any physical injury, death or property damage arising from any firearm purchased, sold or transferred in connection with a listing on the Platform

8.2 Cap on Liability

To the maximum extent permitted by law, GunBuy's total aggregate liability to you for all claims arising from or relating to your use of the Platform is limited to the total fees paid by you to GunBuy in the 12 months immediately preceding the event giving rise to the claim or $100 whichever is greater.

8.3 Liability for User Conduct

GunBuy accepts no liability whatsoever for the conduct, statements, representations, actions or omissions of any user of the Platform including any seller, buyer or dealer. Any dispute between users must be resolved between those users directly. GunBuy has no obligation to participate in or facilitate the resolution of any user dispute.

8.4 Liability for Third Party Services

The Platform may contain links to third party websites, services or content. GunBuy accepts no liability for the content, accuracy, availability or practices of any third party. The inclusion of any link does not imply endorsement by GunBuy.

9.1 User Indemnity

You agree to fully indemnify, defend and hold harmless GunBuy, its directors, officers, employees, contractors, agents and successors from and against any and all claims, demands, actions, proceedings, losses, damages, liabilities, costs and expenses (including reasonable legal fees) arising from or relating to:

• Your use of the Platform
• Any listing you create on the Platform
• Any transaction you enter into in connection with the Platform
• Your breach of these Terms
• Your violation of any applicable law including any firearms legislation
• Your infringement of any third party right
• Any claim by a buyer, seller or third party arising from a transaction you are party to
• Any physical injury, death or property damage arising from a firearm you list or sell
• Any misrepresentation you make on the Platform or in connection with a transaction
• Any failure to comply with mandatory dealer transfer requirements
• Any fraudulent activity on your part

9.2 Ongoing Indemnity

This indemnity survives termination of your account and your cessation of use of the Platform.

10.1 GunBuy Intellectual Property

All content on the Platform including the GunBuy name, logo, design, software, text, graphics, data compilations and other materials are the intellectual property of GunBuy or its licensors. You must not reproduce, distribute, modify or create derivative works from any GunBuy intellectual property without our express written consent.

10.2 User Content Licence

By posting any content on the Platform including listing descriptions, photos or messages you grant GunBuy a non-exclusive, worldwide, royalty-free, perpetual licence to use, reproduce, modify, adapt, publish, translate and distribute that content in connection with operating and promoting the Platform. You warrant that you own or have the right to grant this licence and that your content does not infringe any third party right.

10.3 Listing Data

GunBuy may use aggregated and anonymised listing data for the purpose of producing market reports, analytics and platform improvements. This does not include personally identifiable information and is subject to our Privacy Policy.

11.1 Privacy Policy

GunBuy collects, uses, stores and discloses personal information in accordance with our Privacy Policy which forms part of these Terms. By using the Platform you consent to the collection and use of your personal information as described in our Privacy Policy.

11.2 Licence Document Storage

Firearms licence documents submitted for verification are stored securely and used only for the purpose of verifying your eligibility to use the Platform. GunBuy will retain licence documents for a period of 7 years after account closure in accordance with our record keeping obligations and for the purpose of cooperating with law enforcement investigations.

11.3 Law Enforcement Cooperation

GunBuy will disclose user data including registration information, listing history, messaging records and licence documents to law enforcement authorities upon receipt of a valid warrant, subpoena, court order or other lawful request. GunBuy may also proactively disclose information to law enforcement where we have reasonable grounds to believe a serious offence has been or may be committed.

11.4 Privacy Act Compliance

GunBuy handles personal information in accordance with the Privacy Act 1988 (Cth) and the Australian Privacy Principles. Users have the right to access and correct their personal information held by GunBuy subject to the exceptions set out in the Privacy Act.

12.1 User to User Disputes

GunBuy is not responsible for resolving disputes between users. All disputes arising from transactions, listings or communications between users must be resolved between those users directly. GunBuy may at its sole discretion provide assistance in resolving disputes but has no obligation to do so.

12.2 Disputes with GunBuy

If you have a dispute with GunBuy you must first contact us in writing at contact@gunbuy.com.au and provide full details of your complaint. GunBuy will endeavour to respond within 14 business days. If the dispute is not resolved through this process either party may refer the matter to mediation through the Australian Disputes Centre or a similar body before commencing legal proceedings.

12.3 Governing Law

These Terms are governed by the laws of Queensland, Australia. You irrevocably submit to the exclusive jurisdiction of the courts of Queensland, Australia and any courts competent to hear appeals from those courts.

12.4 Class Action Waiver

To the maximum extent permitted by law you agree to bring any claim against GunBuy only in your individual capacity and not as a plaintiff or class member in any purported class or representative proceeding.

13.1 Dealer Representations

By registering as a dealer you represent and warrant that:

• You hold a current valid firearms dealer licence issued under the applicable state or territory legislation
• You will maintain that licence in good standing for the duration of your use of the Platform
• All staff who access the Platform on your behalf hold any required licences or authorisations
• Your business operations comply with all applicable firearms legislation, consumer law and business regulations
• You will notify GunBuy immediately if your dealer licence is suspended, cancelled, revoked or subject to any investigation

13.2 Dealer Subscription Terms

Dealer subscriptions are billed monthly in advance. Subscriptions automatically renew unless cancelled at least 7 days before the next billing date. No refunds are provided for partial months. GunBuy reserves the right to change subscription pricing with 30 days written notice to the dealer's registered email address.

13.3 Dealer Conduct Standards

Dealers must maintain professional standards of conduct on the Platform including responding to enquiries within a reasonable timeframe, accurately representing stock condition and availability, honouring advertised prices and complying with all obligations under the Australian Consumer Law in dealings with buyers.

13.4 Dealer Termination

GunBuy may terminate a dealer account immediately without refund where the dealer's licence is suspended or cancelled, where the dealer engages in conduct that in GunBuy's sole opinion damages the reputation or integrity of the Platform or where the dealer breaches these Terms.

14.1 Fee Schedule

Current fees for listing upgrades, featured placements and dealer subscriptions are as published on the Platform at the time of purchase. GunBuy reserves the right to change fees at any time with notice published on the Platform.

14.2 GST

All fees are inclusive of GST where applicable. GST compliant tax invoices are issued automatically for all payments.

14.3 No Refunds

All fees paid to GunBuy are non-refundable except where required by the Australian Consumer Law. This includes listing upgrade fees, featured placement fees and dealer subscription fees. If GunBuy removes a listing for breach of these Terms no refund of any associated fees will be provided.

14.4 Chargebacks

If you initiate an unauthorised chargeback or payment reversal GunBuy may immediately suspend your account and pursue recovery of the disputed amount plus any associated fees and costs.

15.1 Entire Agreement

These Terms together with the Privacy Policy constitute the entire agreement between you and GunBuy regarding your use of the Platform and supersede all prior agreements, representations and understandings.

15.2 Severability

If any provision of these Terms is found to be invalid, unenforceable or illegal by a court of competent jurisdiction that provision will be severed from the Terms and the remaining provisions will continue in full force and effect.

15.3 Waiver

GunBuy's failure to enforce any provision of these Terms does not constitute a waiver of that provision or GunBuy's right to enforce it in future.

15.4 Assignment

GunBuy may assign its rights and obligations under these Terms to any successor entity without your consent. You may not assign your rights or obligations under these Terms without GunBuy's prior written consent.

15.5 Force Majeure

GunBuy is not liable for any failure or delay in performance resulting from circumstances beyond our reasonable control including natural disasters, government actions, changes in law, cyberattacks or telecommunications failures.

15.6 Relationship of Parties

Nothing in these Terms creates any employment, agency, partnership, joint venture or franchise relationship between you and GunBuy.

15.7 Notices

GunBuy may provide notices to you via email to your registered address, via a notification in your account dashboard or via a notice published on the Platform. Notices are deemed received upon sending. You may provide notices to GunBuy by email to legal@gunbuy.com.au.

15.8 Survival

Any provision of these Terms that by its nature should survive termination will survive including without limitation the indemnity provisions, limitation of liability provisions, intellectual property provisions and governing law provisions.
